In furtherance of this, Algerio made statements to the Office of the District Attorney that were false and that he knew were false, including that he observed the plaintiff push an individual, attempt to strike such individual with a closed fist, and that the plaintiff ignored instructions from defendant police officer Algerio and flailed his arms and pulled himself free from Algerio's grip.
