His son punched him in the face and plaintiff's fiancee and her son intervened to prevent any further conflict. Plaintiff never struck his son in any way or threatened to. Multiple family members witnessed the incident. One of plaintiff's son's called the police and ten unidentified officers arrived, including Officers Goodman, Imbert, Hernandez, and Breheny. Officers entered the backyard, where plaintiff was, without consent or a warrant. Some of the officers entered the interior of the home from the backyard without consent or warrant. Some of the officers made jokes that plaintiff should pretend to fall down and sue the owner of the property. Plaintiff tried to explain to officers what transpired but they did not pay attention. His fiancee tried to explain and they refused to listen to her and told her that she was \"no one.\" \n\nOfficers inside the house spoke to plaintiff's son—who had hit plaintiff—but did not speak to any other witnesses. Officers then handcuffed plaintiff and arrested him. Plaintiff was taken to an NYPD vehicle and was not given the chance to put on pants or clothe himself despite his requests. He was held at a precinct for hours and then taken to booking where he was arraigned. He was charged with menacing and harassment. Officer Goodman was the deponent in the criminal court complaint against plaintiff and stated that plaintiff's son informed him that plaintiff had pointed a wooden stick at his son and threatened him. These allegations are false.
