Gomez and Diggs approached the Plaintiff while she was walking down the street and arrested her without probable cause. At the time of the incident, the Plaintiff was struggling with a severe heroin addiction and engaged in prostitution to support her addiction. The Defendants knew the Plaintiff, as she had been arrested before. However, at the time of the incident, the Plaintiff did not have any drugs or paraphernalia on her person and informed the Defendants of this. The Defendants responded by saying, “Well, we know what you are doing,” and proceeded to arrest her anyway.\n\nAt the precinct, the Plaintiff was repeatedly moved between the arrest room, where she was handcuffed to a bench, and a private room. During her first time in the private room, Defendant Gomez informed her that he had gone through her phone. He asked if she was being forced to give money to anyone and asked her to work as an informant, which she declined. During her second time in the private room, Defendant Gomez told her she “was put in for DAT” or a Desk Appearance Ticket. When the Plaintiff expressed uncertainty due to previous experiences, Defendant Gomez replied, “We’ll have to see what Albany says.” During the third time in the private room, Defendant Gomez informed the Plaintiff that her DAT request had been denied. The Plaintiff began crying, fearing that she would go to jail, experience withdrawal symptoms, and become sick. Defendant Gomez then stated that he might be able to overturn the denial. When the Plaintiff asked what he wanted in exchange, believing he would ask her to “snitch” on someone, Defendant Gomez got close to Plaintiff and said, “You know what I want,” in a suggestive manner. The Plaintiff repeatedly stated that she was unsure of what he wanted, but he continued to repeat the phrase. Eventually, the Plaintiff asked if he was requesting a sexual act, to which he responded yes.\n\nDesperate to avoid jail and the effects of withdrawal, the Plaintiff agreed. Then Defendant Gomez threatened that if she failed to fulfill her promise, he would hunt her down, ensure there was no place in the Bronx where she could hide, and arrest her every time he saw her. During their fourth interaction, Defendant Gomez handed her the DAT and made her write down her phone number. After her release and shortly before meeting with Defendant Gomez again, the Plaintiff used heroin. Defendant Gomez later picked her up, drove her to an industrial area, and forced her into performing oral sex. Afterward, he told her this was only the first payment for what he had done for her.
