They ignored Plaintiff's pleas of innocence and proceeded to handcuff and search him without legal cause. They did not find any contraband. Plaintiff was placed under arrest and placed in a holding cell at the precinct. At the precinct, Officer Rashawn Holman forcefully dragged Plaintiff out of the holding cell by the hood of his hooded sweater and handcuffed and shackled Plaintiff to other inmates. Plaintiff was then escorted outside to the police van by Officer Holman who forcefully held and led Plaintiff by his arm. Officer Holman without cause, yanked Plaintiff by his arm and punched him in his right eye, unannounced. Plaintiff fell unconscious due to the force of the blow, and was continued to be punched and kicked by Officer Holman. Upon gaining consciousness, Plaintiff was bleeding and asked to be taken to the emergency room, but Officer Holman refused the request and transported Plaintiff to Central Booking. At Central Booking, a clerk advised officers that Plaintiff should not appear before the judge in the condition he was in and should be taken to the emergency room. The officers complied, and Plaintiff received several sutures on his right eye and left chin. He was handcuffed and transported to the precinct, where he was treated by EMS for facial wounds caused by defendant Holman, including cuts to his nose and abrasions on his forehead. As the plaintiff began to walk up the stairs to exit the subway station, passing the defendants, Defendant Goldstein approached plaintiff and asked for his identification. Then, without cause, Defendant Goldstein maliciously shoved the plaintiff up the stairs of the station and handcuffed him while he was on the ground. Both defendants lifted the plaintiff from the ground by the handcuffs. Detective Goldstein asked the plaintiff if he had any drugs and then conducted an overly invasive search, lifting his shirt and exposing his bare torso. The plaintiff was arrested and Defendant Holman knowingly swore to false charges. He walked to the Manhattan-bound \"E\" train platform. The train was sitting stationary on the platform with only one door open since it was the terminal stop. Plaintiff and scores of other passengers boarded the train through the one open door and\nwalked between the cars in order to spread throughout the stationary train. Holman ordered plaintiff to get off the train and come speak with him. Plaintiff complied and provided his identification. Holman indicated he was going to arrest plaintiff for walking between the cars. Plaintiff verbally protested. Holman ordered plaintiff to sit down on a nearby bench and grabbed his canister of pepperspray. Another officer, Bekas approached the scene. Holman jumped on plaintiff's back and yelled \"HE'S RESISTING!\" Plaintiff was tackled to the ground. Holman discharged a large amount of pepperspray directly into plaintiff's eyes, and Holman repeatedly drove his knee into plaintiff's back. Officers took plaintiff to a nearby police station. After spending a short time in the precinct, plaintiff was transported to Jamaica Hospital Center where they treated his injuries. He was then taken back to the precinct. Holman and Bekas forwarded false information about the incident to the prosecutor, causing the prosecutor to press various criminal charges. A grand jury refused to indict plaintiff.
