Nonetheless, Defendant Officers arrested Plaintiff on attempted murder and other felony charges. Plaintiff was placed in a sham lineup and wrongfully identified by the witness. Plaintiff spent about seven months on Rikers Island, where he was sprayed with several chemical agents on several occasions. Plaintiff was placed in a black car and driven around for about 4 hours before being taken to the 40th precinct. He was questioned by officers including defendants Monge and/or Chevere. Officer Chevere showed numerous photos to the victim of a crime. Chevere was aware that the victim was unable to adequately describe her attacker by age or other physical characteristics. However, CHEVERE knew that the victim described her attacker as 6’,1”. Nonetheless, CHEVERE showed random of photos of possible suspects, one or more of which was 5’,6”, some seven inches shorter than the attacker described by the victim. The victim saw someone in the photo and said she was unsure if it was the attacker, but that his face might resemble the attacker. The victim was not informed of the height of the person in the photo and only saw the face. The officer then misrepresented the victims statements and said that she had definitively identified Plaintiff as the attacker. She was asked to circle the photo of Plaintiff, which she did. The victim was also not fluent in English, and no effort was made to accommodate this. \n\nAt the Precinct, Palacios requested medical treatment, which he was denied. He was held at the precinct for approximately 12 hours before being transferred to central booking. He was then held at central booking for 24 hours before being released.
