EMS operators brought Plaintiff to Elmhurst hospital and underwent surgery. While recovering from his injuries and surgery, NYPD officers without any probable cause or charges against Plaintiff detained him with handcuffs and held him against his will from November 29, 2018 to December 11, 2018. NYPD Officers implemented its \"Hospitalized Prisoner\" policy against Plaintiff requiring his family to submit \"Hospitalized Prisoner\" forms to be approved in order to visit Plaintiff, and detaining him despite lack of charges in order to obtain information from Plaintiff. The shackles on Plaintiff interfered with his medical treatment but NYPD did not remove them despite doctors, nurses and hospital officials informing NYPD they could not perform his medical care with them on.
