Plaintiff assisted a man who was struck by a bike by a Strategic Response Group officer. At around 8:30 pm, Plaintiff was subsequently tackled to the sidewalk by approximately four other officers, including Defendant Paul Rau. The defendants smashed Plaintiff's head to the ground and pinned Plaintiff on his back. One officer stood on Plaintiff's left wrist, while another officer stood on his right wrist, pinning him to the ground. Plaintiff's neck was pressed against, and he indicated that he could not breathe. While Plaintiff was pinned on his back, Defendant Rau, aided by several other officers, punched Plaintiff in his face several times and yelled \"stop resisting\" even though Plaintiff was not resisting. In the course of being punched, Plaintiff's molar was knocked out, nearby teeth were cracked, his cheekbone was fractured, and his mouth became bloody. In the course of arresting Plaintiff, Plaintiff's left arm was violently yanked, causing dislocation of his left shoulder. Plaintiff complained to the officers that the handcuffs were hurting his left wrist but he was told to stop talking, and nothing was done to loosen the handcuffs. At some point in time, an unnamed police officer removed Plaintiff's mask, which he was wearing to protect himself from COVID-19.\n\nWhile Plaintiff was in handcuffs waiting for a bus that would take him to the police station at 1 Police Plaza, unnamed NYPD officers ripped off a pouch from his person containing his cell phone and wallet and discarded it on the street. Plaintiff's helmet, knee guards, arm guards, and individual first-aid kit were also taken from him. Plaintiff was transported to the station for arrest processing and released 3:15 am the next morning (on November 5, 2020) with a Desk Appearance Ticket that identified Defendant Victoria Hurchey as his arresting officer and Sgt. Stefopoulous Nikoloas as the Desk Officer. Plaintiff appeared in New York County Criminal Court on January 22, 2021 and was arraigned based on purposeful fabrications by Defendants Hurchey and Rau that Plaintiff interfered with Defendant Rau as Defendant Rau tried to arrest another individual and that Plaintiff refused to put his hands behind his back. On April 1, 2021, Plaintiff made his court appearance, and on May 6, 2021, the prosecution was dismissed.
