After a two-month investigation after this incident, the plaintiff was arrested when she arrived at 32nd precinct, when she voluntarily appeared after reporting the assault, with the understanding she was at the precinct to answer more questions. The plaintiff was arrested at the precinct, transported to central booking and charged, before arraigned before a judge about 18 hours or more later. The plaintiff alleged that police officer/detective knowingly misrepresented to her that she would not be taken into custody when she arrived and was wrongfully charged with attempted assault with intent to cause physical injury with a weapon and assault with intent to cause physical injury . After several appearances before a judge before the New York County Supreme Court, the charges against the plaintiff were dismissed on April 17, 2023.
