Plaintiff offered no resistance. Shortly thereafter, angered by Plaintiff’s complaints that the officers had not apprehended the individual who had stolen his phone, the officers beat Plaintiff. PO Michael McManus used an asp and hit Plaintiff on the leg. \n\nOnce at the precinct, Plaintiff was placed in a holding cell. He complained that he was injured and needed attention. The officers then told Plaintiff to stop complaining. Plaintiff persisted in asking for medical treatment and demanded to know why he was arrested and beaten, whereupon PO Victor Whilchez pulled Plaintiff out of the cell and punched him in the face. Other officers from the precinct joined in the assault. Plaintiff thereafter again pleaded for medical attention, and was finally taken to the hospital. PO McManus and Whilchez falsely informed the DA’s Office that they had observed Plaintiff commit several crimes/offenses, in an effort to cover up their unlawful assault of him.
