The assault and battery consisted of being pushed to the ground, assaulted with a Taser and/or other conductive energy device; grabbed, had his arms pulled behind his back, pushed on his back into a car and then was forcefully placed in handcuffs. Medical attention was ignored at the request of Plaintiff. Plaintiff was placed under arrest and was placed in a\npolice vehicle where he was taken to the police precinct. While in the vehicle, Plaintiff continued to be abused by Defendants, including furthering injuring his left shoulder as a result of being grabbed out of said vehicle and having his backpack pulled over his left shoulder as it was being severed. Upon arrival at the precinct, Plaintiff was treated for his injuries by the Emergency Medical Services personnel. He then was taken to NYU Langone Hospital, Brooklyn for further medical treatment while in handcuffs and leg shackles under police custody. Plaintiff was tackled to the ground, struck and tased by at least some of Defendants police officers Tristian Trunk, Frank Beers, Thomas Owens, Mohammed Hyatt, Mario Bueno and John Lewis. Plaintiff was not in possession of a handgun and there was no reasonable basis to believe that he had fired a handgun. Despite this absence of sufficient legal cause, Plaintiff was arrested, handcuffed and transported to a NYPD station house where he was jailed. PO falsely claimed that they had witnessed Plaintiff commit various crimes, including the criminal possession and discharge of a handgun. Consequently, Plaintiff was charged with Attempted Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree. As Plaintiff was unable to post bail, he remained incarcerated for 20 months, from the time of his arrest through and beyond the final verdict following his trial.
