As Plaintiff passed the third floor he saw an officer with his gun out. Plaintiff called his sister on the phone because the sight of the police offers with guns out made him anxious. The Police ordered Plaintiff to come down to the third floor where they handcuffed and arrested him without probable cause. Officer Lunetta and John Doe 1-3 brought Plaintiff down the stairs with excessive force, injuring Plaintiff's ankle. Plaintiff was brought before a judge and was dismissed. On February 17, 2023, there were two knifepoint robberies in the vicinity of Plaintiff's apartment building. Officer Lunetta advise Detective  Longo that the still from the video of one of the robberies reminded him of Plaintiff and Plaintiff had a knife on him when Officer Lunetta arrested him on the 15th. Detective Longo used the arrest photo to create a photo array and one victim of the robberies identified Plaintiff. Neither the photo nor the existence of the work knife recovered during Plaintiff's previous arrest were properly used to establish probable cause to arrest Plaintiff for the robberies. Plaintiff was arrested for the robberies the Kings County District Attorney decline to prosecute.
