Defendant, NYPD officer Palmer stopped Plaintiff asked where he was going and told Plaintiff he would search him. Plaintiff refused and asked why he was being searched. Defendant Palmer refused to answer him and started aggressively searching Plaintiff, specifically his neck, shoulders, arms, chest and waistband and aggressively grabbed Plaintiff's genital demanding that Plaintiff produce a gun. Plaintiff said he did not have a gun. Defendant handcuffed Plaintiff and searched him 3 more times, each time aggressively grabbing Plaintiff's genitals. Plaintiff was turned to face an unmarked car and said that the person in the car identified him as not the shooter and then was put in a police vehicle. Plaintiff complained that the handcuffs were too tight but Palmer refused to loosen them. Plaintiff was taken to the 28th Precinct where he was searched again. Plaintiff was taken to the pen and told to remove his shoelaces and hoodie strings. Defendants Santiago and Sanchez took Plaintiff to a back room and Santiago forced Ross to strip his clothes and Santiago told him to take everything off including his socks. Plaintiff asked why he had to strip and Santiago threatened to taser Plaintiff if he refused. Plaintiff removed all of his clothes. Santiago told Plaintiff to turn around, squat, spread his butt cheeks and cough in front of other Defendants. Plaintiff complied and then Santiago told him to do it again and if not he would tase him. Plaintiff was humiliated. Plaintiff then was told to leave because he was not the shooter they were looking for. Palmer patted Plaintiff on the shoulder and apologized for the inconvenience as he and his fellow officers laughed at Plaintiff. The pistol was recovered from the seat of the vehicle by Officer Santiago.  According to testimony from Santiago , during this time plaintiffs were sitting in the vehicle with their hands in their laps\" Plaintiffs were dragged out of the vehicle and slammed to the ground and beaten . At no time during this incident did plaintiffs commit any crime.  Despite these facts plaintiffs were arrested and charged with Criminal Possession of a Weapon in the Second Degree.  Plaintiffs both spent over 24 hours in custody .
