Without provocation, a woman unknown by Plaintiff started aggressively verbally harassing Plaintiff, who ignored the woman and tried to walk away from her. Without provocation, the woman physically attacked Plaintiff, striking him in the face and ear with a high heel shoe, causing a laceration to Plaintiff's ear and bleeding. Plaintiff feared for his life and safety and attempted to defend himself; there were numerous witnesses, at least one of whom filmed the woman attacking Plaintiff without provocation before Plaintiff attempted to defend himself. Police officers entered the train at West 4th Station and were told by all witnesses that the woman was the aggressor, viewed the video, and saw Plaintiff bleeding while the woman-assailant did not have any injuries. \n\nOfficer Binagi and ten John Doe police officers handcuffed and arrested Plaintiff and transported him to a hospital for medical treatment for his injuries before transporting him to a precinct. The officers falsely communicated to the Manhattan DA that Plaintiff had committed a crime despite clear video evidence to the contrary and withheld the video from the DA's office. After several hours at the precinct, plaintiff was transported to Central Booking and detained for a total of 36 hours before being arraigned. Plaintiff was unable to pay $1000 bail and was remanded into custody. On or about November 11, all charges against Plaintiff were dismissed and he was released.
