Thereafter, Plaintiff was forced to hire private counsel and was required to make five court appearances. A grand jury convened and returned a “no true bill”, as the prosecution’s evidence did not persuade the grand jury that that there was probable cause to believe Plaintiff committed a crime. Plaintiff was informed of this grand jury ruling that took place in July of 2023 during his final court appearance on or about September 22, 2023. PO Rivera and PO Varrone maliciously supplied false information to the DA's office, instigating the commencement of the criminal prosecution of the Plaintiff. At arraignment bail was set but Plaintiff was unable to post bail. He was therefore detained at Riker's Island for 48 hours until he could post bail.
