Police were requested to help effectuate service. PO Villanueva and an unnamed officer arrived and service was effected without incident. Suddenly POs told Plaintiff to place his hands behind his back and did not respond to Plaintiff's requests for explanation. Plaintiff began walking away when PO Villanueva and John and Jane Doe 1-20 approached, and yelled at and threated Plaintiff causing Plaintiff to fear for his safety. Plaintiff was grabbed and shoved to the ground with PO knees in his back. Plaintiff was then handcuffed in an excessively-tight manner, causing extensive and embarrassing wrist scarring. After Plaintiff was on the ground in handcuffs and had been for some time, PO Villanueva drew her firearm and pointed it at Plaintiff with no legal justification. \n\nPlaintiff was arrested for two incidents: the August 7, 2019 or 2020 encounter previously described and an April 9, 2019 allegation from Plaintiff's neighbor, who had caused Plaintiff considerable harm including filing false police reports. The allegation was captured on video that demonstrates Plaintiff did not commit a crime. Prior to the August 7, 2019 or 2020 arrest, PO Martinez had seen the video and knew there was no probably cause to arrest Plaintiff. Plaintiff was unlawfully searched, brought to the 43rd Precinct where he was processed--including an invasive intimate search--and transferred to Central Booking. During this time POs Villanueva and Martinez falsified information regarding the incidents in order to initiate malicious prosecutions.
