Mr. Tobon observed eight NYPD officers approach him, and they commanded him not to leave the area as it was potentially a crime scene. Mr. Tobon wa confused and questioned the Officers as to why he was being detained. At this point, a female officer gestured to Mr. Tobon to move back. A male officer then  began pushing Mr. Tobon backwards while screaming “get back.” The Defendant Officer continued to push and step on Mr. Tobon and placed himself very close to Mr. Tobon's body, so close that Mr. Tobon's hands touched Defendant Officers’ chest. Once this happened, the  Defendant Officer proceeded to grab Mr. Tobon and slam him to the ground on his\nface and causing his ribs to slam into a scaffolding pole. The other Defendant Officers then jumped onto Mr. Tobon, pulled his hair, put his face to the ground, placed him in handcuffs and picked him up. The force used by Defendants caused Mr. Tobon personal, physical, and emotional injuries, the extent of which are still unknown.\n\nThe Defendant Officers then transported Mr. Tobon to the 43rd Precinct, where he was detained for six hours. While Mr. Tobon was in illegal custody, the Defendants prepared false sworn affidavits and false police reports and repeatedly falsified information relating to the facts and circumstances surrounding his arrest. The Defendant police officers falsely stated to the Bronx County District Attorney’s Office that Mr. Tobon had committed a crime despite knowing that they lacked a legal and a factual basis to allege that Plaintiff committed any crime. After six hours, Mr. Tobon was then given a desk appearance ticket. The NYPD officials ordered the occupants to freeze and drop to the floor—an instruction that the plaintiff obeyed.  While the plaintiff lie face down on the floor, the NYPD officers kicked him repeatedly, causing him pain.  At no time did the NYPD defendants have an objective, factual basis to believe that the plaintiff violated any laws.  The plaintiff showed the NYPD defendants his government-issued identification card establishing that he was not a resident of the apartment.  Nevertheless, the officers arrested the plaintiff, transported him to the PSA4 Precinct, subjected him to a search, fingerprinting, and photographing, and locked him in a cell containing rodents and insects.  After several hours, the defendants transported the plaintiff to the New York County Central Booking facility, where the plaintiff remained in another holding cell.  \n\nA few days later, on February 20, 2015, the plaintiff was charged with crimes of which the NYPD defendants lacked probable cause to accuse the plaintiff.  The plaintiff thereafter remained in custody until February 24, 2015.
