They told him that the prior night a woman had been assaulted by a black man wearing a similar coat to the one Mr. Jackson was wearing. They pressured Mr. Jackson into handing over his identification and allowing them to take photos of him and his ID, after which they permitted him to leave. \n\nOn or about February 8, 2019, at 8:30 p.m., Mr. Jackson was stopped on Harrison Street near its intersection with Main Street in New Rochelle by Officer Kane of the New Rochelle Police Department (\"NRPD\"). Officer Kane told Mr. Jackson that there was a warrant for his arrest. That statement was a lie; the NYPD had issued an \"i-card\" stating that Mr. Jackson was wanted for a rape that occurred on January 19, 2019. The i-card asked that anyone with information notify Officer Erato and lists Officer Cruz as the assigned investigator. Mr. Jackson informed Officer Kane that there was no warrant for his arrest. Officer Kane checked Mr. Jackson's identification and then handcuffed him; he never contacted Officers Erato or Cruz nor any other NYPD officer prior to this arrest. Officer Michael Moe of the NRPD arrived at the scene and took Mr. Jackson to a NRPD station by car. \n\nOfficer Abear of the NYPD (along with a Joe Doe officer) arrived and took Mr. Jackson to Queens in an NYPD car where he was placed in an interrogation room. The officers questioned Mr. Jackson nonstop for three hours. They made him unlock his cellphone so that they could inspect its contents outside of the room. Detective Abear falsely told Mr. Jackson that his semen had been found inside a woman in relation to a sexual assault. Mr. Jackson was informed that his wife had retained a lawyer and that he would be released at noon on February 9, 2019; his jacket and cellphone were not returned to him. Officers Ropenus and Abear informed him that his phone was being sent to a company to be opened and accessed against his will; it was never returned to him. Zizzo intentionally stepped on and broke them before he collected them. Plaintiff was brought to a police car and taken to the 115th Precinct. At the precinct, Plaintiff requested medical attention. Plaintiff was taken to Elmhurst Hospital for treatment. Later that day, Plaintiff was taken to Central Booking, arraigned, and was charged with resisting arrest and criminal trespass. Zizzo signed the Criminal Complaint falsely charging Plaintiff. Plaintiff was released on his own recognizance. Plaintiff was forced to appear multiples times in Queens Criminal Court over two years. On July 31, 2013, Zizzo testified falsely at a pretrial hearing. Plaintiff was forced to stand trial, lasting two weeks. Zizzo and Cruz both testified falsely at the trial. Also present in the car was a second Caucasian man. The car was stopped by police officers. The three men were ordered out of the car at gunpoint. Plaintiff complied, and asked what was happening. Plaintiff was not engaged in any criminal conduct or in possession of any contraband. In response to Plaintiff’s question, one or more of the officers moved to strike Plaintiff and put him in handcuffs. During the incident, Plaintiff was also, inter alia, grabbed by, on information and belief, PO Serafin Resto, who proceeded to forcefully punch Plaintiff in the face so hard that the officer fractured one or more of the bones in his hand. Additional officers joined PO Resto in beating Plaintiff as he lay on the ground. Several of Plaintiff's front teeth were cracked and fractured, permanently disfiguring him. Officers did not similarly detain or brutalize the two Caucasian individuals otherwise similarly situated to Plaintiff, although they were actually found to be in possession of unlawful narcotics. \n\nPlaintiff was transported to a police precinct, where he was held for several hours before being transported to a hospital for medical treatment. Upon arriving at the precinct, Plaintiff was searched. The search revealed no contraband. Plaintiff was charged with felony sale of a controlled substance, and assault on a police officer, among other crimes and offenses. On information and belief, both of the Caucasian individuals present in the car were in possession of quantities of heroin, and made a deal with the police to falsely accuse Plaintiff of having sold them the drugs and were later released from custody with Desk Appearance Tickets. The police officers made false allegations against Plaintiff. PO Resto falsely alleged that he saw an exchange of some sort between Plaintiff and one of the two Caucasians in the front seat of the car before police approached the vehicle. POs Erik Nelson, Eric Sonnenberg, Resto and Brian Ritto complained, or made false allegations, about Plaintiff assaulting them; upon information and belief, those claimed injuries were sustained while unjustifiably beating Plaintiff.
