As Plaintiff was entering his girlfriend’s building, he observed a large crowd of people running out. Plaintiff then also ran out of the building. At this moment, Defendant P.O. Joseph Ingui, P.O. Ciaran Tracey and some other police officers arrived at the above location and acted in concert with another by tasing Plaintiff. Plaintiff experienced substantial pain to his right elbow, right rib area and entire body. As a result of being tased, Plaintiff also urinated on himself, then dropped to the ground. Later, Ingui, Tracey and other defendants handcuffed and falsely arrested Plaintiff. At no time did Plaintiff engage in any criminal or unlawful behavior. After the arrest, Plaintiff was transported to the 44th precinct. While being there, he was held in a cell with numerous other male prisoners and remained handcuffed for several hours. Plaintiff was then transported to Bronx County Central Booking located at 215 East 161 Street, Bronx, NY 10451, and later to a local Bronx hospital where he was treated for his tasing injuries. While at the hospital, Plaintiff was handcuffed for several hours. He was subsequently transported back to the Central Booking, and held in a cell with numerous other male prisoners for several hours. On or about August 5, 2017, Plaintiff was arraigned in Bronx County Criminal Court. He was maliciously prosecuted by Defendants for Disorderly Conduct, Resisting Arrest and Harassment in the Second Degree. Plaintiff was released on his own recognizance at the time of arraignment. Between that date and May 17, 2018, Plaintiff made several court appearances until the matter was dismissed upon application of the Bronx County District Attorney. As a result of Defendants’ actions, Plaintiff was seriously injured.
