Plaintiffs were taken to the 52nd Precinct then Central Booking, and were ultimately unlawfully detained for approximately 40 hours. POs intentionally forwarded false information to initiate a malicious prosecution against Plaintiffs. All charges against Plaintiffs were ultimately dismissed. Without any probable cause, reasonable suspicion, or legal justification, Defendants falsely accused Plaintiff of criminal drug possession. Although Plaintiff offered information that would vindicate her, Defendants ignored and refused to listen to Plaintiff. Instead, Defendants aggressively and illegally seized Plaintiff’s person by grabbing her head and searched her person by rifling their hands in and out of her clothes and personal belongings despite having no reason to do so. Next, the Defendants grabbed Plaintiff’s body and extremities, violently contorting her arms behind her back, and excessively tightened metal handcuffs Plaintiff’s hands. \n\nAlthough Plaintiff requested to the Defendants that they should loosen the handcuffs due to their tightness and the great pain and discomfort they caused, Defendants nevertheless ignored her requests and placed Plaintiff in a police vehicle. Defendants took Plaintiff to the NYPD 40th Precinct, where she was fingerprinted, photographed, searched, or strip-searched, questioned about her pedigree, illegally interrogated without counsel, and illegally detained in a dank and dirty cell. Next, Defendants placed Plaintiff in another police vehicle and took her to Central Booking where she was processed once again and detained in another dirty and dank cell. Plaintiff was released from physical custody after her arraignment three days later, on or about January 21st, 2024. Defendants maliciously prosecuted Plaintiff by providing false information to the District Attorney’s Office, which ultimately led to Plaintiff being criminally charged until their dismissal and sealing unconditionally on or about October 26th, 2021, in her favor by the Bronx County Criminal Court. Plaintiff believes she was targeted due to her being a Black woman.
