Defendants presented a warrant either prior to or after their entry.  After the Defendants knocked down the apartment door and forced their way inside they forced their way into the plaintiffs bedroom and removed all blankets and sheets from the bed and exposed the plaintiff who was not wearing clothes and forced her to stand on her feet for about 15-20 minutes in front of 5-6 male officers who were present in the room. Plaintiff was humiliated and despite her pleas defendants would not allow her to put clothes on.  Plaintiff was handcuffed and then allowed to sit down and only allowed to dress after officer Jane Doe arrived at the scene.  The defendants ransacked the apartment and Plaintiff was arrested along with her boyfriend David Smith, Her son Isaiah Gray and her Brother Derrick Chirse. The arresting officers did not present a warrant to search Plaintiffs apartment and/or arrest her and Plaintiff was never informed as to the reasons for her arrest and/or any criminal allegations against her.  Plaintiff and her family were transported to 81st precinct and she was fingerprinted photographed and placed into a dirty holding cell.  After spending 10 hours in the cell she was released at around 4:00pm.  Plaintiff was denied a phone call, medical attention, food and water.  Upon release she was given a court desk appearance ticket and returned home to find her apartment ransacked, with the front door and furniture damaged. The officers were pursuing Plaintiff on the basis he may have matched the description of a perpetrator who had fled a police traffic stop. Plaintiff felt threatened and began to run. Some officers exited the vehicle and chased Plaintiff on foot. The officers shot Plaintiff multiple times, without justification, including after Plaintiff was incapacitated. They also placed a gun in the vicinity of the incapacitated Plaintiff. Plaintiff underwent several surgeries to remove the bullets lodged into his body. Plaintiff were falsely charged with crimes, such as attempted murder. On June 27, 2014, he was acquitted of all charges, except for one count which he is currently appealing.
