Defendant officers threw Plaintiff to the ground, kneed him in the back, pushed his face into the ground, and then placed him under arrest with tight handcuffs. At no time did defendants possess probable cause or reasonable suspicion to search  or arrest Plaintiff. Plaintiff was transported to the Precinct and charged with Resisting Arrest and Criminal Possession of a Weapon. Defendants filled out false and misleading police reports and forwarded them to the New York County District Attorney's Office. Specifically, Defendant police officer Frankie Soler falsely stated that he observed Plaintiff to have a large bulge in his waistband that he believed to be a firearm and that he observed Plaintiff removing the bulging object from his waistband, which he stated was a sock, and throwing it into the street and that he further observed that the sock contained a firearm after Defendant Sergeant William Rivera recovered it. Defendant Sergeant Jose Perez falsely stated that he observed Plaintiff repeatedly reach towards the bulge in his waistband and that Plaintiff refused his orders to stop, and that Plaintiff refused to put his hands behind his back, refused to be handcuffed, and refused to stop reaching for the bulge.
