There was no legal justification or provocation from the Plaintiff or the vehicle's passenger that indicated a need for the stop. Defendants then proceeded to assault, accost, batter, search, illegally question, and arrest Plaintiff. Defendants injured the Plaintiff to the point in which he was unable to move freely or leave the scene without him being notified as to why he was being arrested. Next, the Defendants brought Plaintiff to the NYPD 43rd Precinct for one day, then transferred her to Central Booking, where she was held for about two days. Defendants charged Plaintiff with criminal possession of a weapon, specifically a loaded firearm. After arresting and imprisoning Plaintiff, the Defendants provided the members of the Bronx County District Attorney's Office with false statements and worked with them to maliciously prosecute Plaintiff. After Plaintiff's arraignment on October 16th,2022, Defendants transferred Plaintiff to Riker's Island. Plaintiff remained on Rikers Island for approximately one week until his release from custody on or about October 23, 2022. However, all charges placed on Plaintiff were dismissed on April 20th, 2023. As a result of the Defendants' actions, Plaintiff suffered and continues to suffer severe mental anguish, shame, humiliation, emotional distress, damage to his reputation, and physical and emotional traumatization. Furthermore, Plaintiff became sick, sore, lame, and disabled, suffers, still suffers, and will continue to suffer pain and discomfort that causes him to obtain medical care and attention to cure these injuries.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=co7cLYTIVXZFtvkZfC0KqA==","type":"complaint"}]},{"name":"Santana, Daniel vs City of Ny","start_date":"2022-11-04","disposition_date":"2023-04-10","payout_amount":95000,"disposition":"Settlement","docket":"816469/2022E","court":"Supreme Court - Bronx","summary":"On January 4, 2022, police officers James Murphy, Brendan McLaughlin, Paul O'Grady, John Doe and John Roe stopped, seized and arrested Plaintiff in an aggressive and excessive manner without any legal justification.
