Shortly after the protest began, members of the NYPD corralled protestors and forced them into the street. Over a loudspeaker, officers told people the protest was illegal and protestors needed to get on the sidewalk. Gavin attempted to obey this command and get off the street, but this was practically impossible given the police officers in the way and buses were in the way blocking the sidewalk. Sgt. Matthew Tocco grabbed Gavin’s arm and asked where she thought she was going. Gavin told him she was trying to get to the sidewalk. Tocco told her to “shut the fuck up” while P.O. Gerard Dowling grabbed her right arm. Tocco and Dowling kicked Gavin’s feet out from under her, causing her to hit the ground. Tocco and Dowling placed her in handcuffs. P.O.s had no reason to arrest her, she had been trying to comply with the instructions to leave the street. Gavin did not resist arrest. P.O.s assigned her arrest to Jonathan Calderon, who transported her to One Police Plaza, then to Central Booking. Calderon told her he didn’t understand why she was being arrested and told her she should sue.
