The defendants did not actively participate in the unlawful act but were present, observed what happened, and failed to intervene. After the arrest, the plaintiff was taken to the precinct, where defendant Lieutenant Kim, whom the plaintiff had known previously, put a taser to his head and threatened to shoot him with it. The plaintiff was ultimately taken to the hospital before being arraigned and was not charged with resisting arrest.
