The plaintiffs were handcuffed, thrown into police vans, and transported to the 67th Precinct. The officers at the precinct falsely stated in the arrest paperwork that the plaintiffs engaged in various unlawful behaviors. All charges against the plaintiffs were ultimately dismissed or adjourned in contemplation of dismissal. The complaint alleges that the City of New York should have been on notice about the particular officers involved in this incident. Plaintiff had no criminal record or prior arrest history, and suffered from asthma attacks and sickle-cell anemia and has been hospitalized several times for these conditions. While present in Plaintiff's apartment having responded to a domestic disturbance call unrelated to the arrest, Officer Mendes asked plaintiff’s sister, Jalilia Ellis, a developmentally disabled 4 year-old girl, whether her older brother had touched her inappropriately. Ellis did not understand the question or its import, but based solely upon her extremely vague and unintelligible response defendants chose to arrest Mr. Brown. Two adults present, Crystal Gordon (plaintiff’s mother) and Elena Shweky (a family friend) did not say anything to justify the arrest and vigorously protested the arrest, maintaining that plaintiff had not touched his sister inappropriately. Mendes threatened to mace Ms. Gordon when she protested the arrest and he subsequently claimed falsely that Ms. Shweky had said that plaintiff had sexually abused his 4 year-old sister. Despite Ms. Gordon and Ms. Shweky protests, Mendes arrested plaintiff and took him in handcuffs to the 67th Police Precinct. Officer Mendes arrested Plaintiff in his pajamas and did not allow Plaintiff to have a coat or keep his asthma inhaler, on that cold January night, even though Ms. Gordon told Mendes that plaintiff suffers from asthma and sickle-cell anemia. The arrest was approved by Sgt. Brian Bartley. Despite being taken to and examined at Kings County Hospital, no medical evidence was found that Jalilia had been penetrated or molested in any manner. Kings County Assistant District Attorney Shea Scanlon Lomma determined there was insufficient evidence to prosecute plaintiff for any of the charges alleged by Mendes.
