Plaintiff was nude for at most minutes if not seconds before Mr. Golub completed his art. Mr. Golub painted several additional nude models throughout the day, which was observed by POs who did not intervene or protest at that time. In the evening, well after Plaintiff had been painted, PO Stephen Mazzaro, Sgt. Munoz, and POs John Does 1-10 suddenly approached Plaintiff and arrested her without legal justification. Plaintiff attempted to put her clothing on and in the process her dress was ripped. Mr. Golub explained it was legal for Plaintiff to be painted in the nude but POs brought Plaintiff to a precinct, where she was denied food and water. Plaintiff was arraigned on the evening of July 31, 2011 and maliciously charged with Public Lewdness and Exposure of a Person. All charges were dismissed on or about April 12, 2012.
