The officers then proceeded to shatter the driver's side window, which caused the Plaintiff to suffer minor lacerations, and a piece of glass to be lodged in his eye. Plaintiff then began to open the passenger door, but before he could exit, the officers grabbed him and pulled him out of the vehicle. They then pressed a taser gun against Plaintiff's chest without shooting it. Despite not having probable cause or any legal justification, the officers handcuffed the Plaintiff, placed him under arrest, and transported him to the 69th Precinct, where he was searched and detained for many hours. The officers then issued him a criminal summons for allegedly resisting arrest and released him from custody. No contraband of any kind was recovered from either the vehicle or Plaintiff's person. Nevertheless, Plaintiff was arrested and charged with \"Improper Coating on Side Windows.\" Plaintiff was taken to the 75th Precinct, and then Kings County Central Booking. After Pantin got into Prescott's car along with an unidentified friend of Pantin's, the car was stopped by Defendant NYPD officer NESLON AYALA (Shield 8811) and four unidentified officers who claimed that they had witnessed \"suspicious activity taking place.\" After one of the officers claimed to have observed Pantin's friend remove something that looked like a gun and place it under the backseat, all three passengers were ordered out of the car and the officers searched the car. All three passengers were then arrested for possession of a firearm. All three Plaintiffs maintain that at no time did they ever see or have knowledge of a firearm in the vehicle. It is unclear if a firearm was actually recovered by the officers. The case was ultimately dismissed by the prosecutor on September 26, 2014. However, as a result of his 36 hour incarceration, Prescott lost his job as a technician at Bellevue Hospital.
