An officer struck plaintiff Luis Jame on his back with a closed fist while plaintiff was walking away from a safe. Plaintiff's life savings, constituting $6,000, were taken by the arresting officers, along with $47,000 belonging to plaintiff Javier Jaime. Officers later returned $34,378 of plaintiff Javier Jaime's appropriated funds, but not the remainder of the funds. The search, during which officers refused to present a warrant, resulted in the damage or destruction of numerous items, including plaintiffs' Playstation Portable console, X-box console, computer, and television. If there was a search warrant, it was issued on the basis of very unreliable information and its lack of reliability was not shared with the issuing magistrate. Plaintiff's arm was twisted behind her back and placed in excessively tight handcuffs after the officers entered her bedroom. She was handcuffed on the floor and taken into the living room, where she vomited and had to be given water and her inhaler (as she suffers from asthma). Another plaintiff was searched, cuffed, and questioned before being brought to the apartment. Both plaintiffs were placed in the police vehicle while the defendants searched the apartment, ransacking it and damaging plaintiffs' personal property. They found no contraband, weapons, or controlled substances throughout their search. Plaintiffs were driven to the 81st Precinct for arrest and processing, and were released several hours later. Defendants conspired to initiate and falsely and maliciously told the Kings County D.A. that plaintiffs had committed crimes including unlawful possession of marijuana.
