The defendant officers tackled Plaintiff to the ground, kicking and punching him with excessive force. The defendant officers did not have any or legal justification. The Plaintiff suffered serious physical injuries. Plaintiff did not resist the defendants in any way. Defendant officers then unlawfully frisked plaintiff. They did not recover any illegal drugs weapons or contraband of any kind from Plaintiff. Nonetheless, defendant officers handcuffed Plaintiff and arrested him without legal justification or probable cause. \n\nPlaintiff transported to the local police precinct, where the defendant officers falsely communicated to the Bronx DA that the plaintiff had committed a crime. Plaintiff was then transported to Bronx Central Booking. After approximately 24 hours, plaintiff was arraigned, and bail was set at $15,000. Because Plaintiff was unable to post bail, he was remanded to the custody of Department of Corrections and transported to the Vernan Bain Center. On or about August 22, 2013, Plaintiff was able to post bail and was released. Officers disabled the lock to the apartment with a hand-drill and then rammed their way into the apartment. The officers were dressed in full riot gear and screamed at the Plaintiffs to get on the floor. Officers shoved Plaintiff mother to the floor causing her extreme terror. Officers cuffed Plaintiff mother and then burst into Plaintiff daughter's bedroom with guns drawn. Once both Plaintiffs were handcuffed, officers placed them on the couch and asked where the drugs were. Plaintiffs explained that they did not have any drugs. Officers threatened to take Plaintiff's dog away and ruin their home if they did not tell them where the drugs were. When Plaintiffs continued to state there were not drugs in the home, the officers conducted an excessively destructive search of the home. Officers never found drugs in the apartment. After the search of the home, Officer Bennett took Plaintiff mother into her room and conducted an illegal strip search. Officer Bennett then repeated this with Plaintiff daughter. Plaintiffs were then taken out of the apartment and placed in an unmarked police van for 2 hours. Plaintiff mother was removed from the van and questioned about drugs again. When it yielded no result, Plaintiff mother was placed back inside the van.
