Regardless, POs grabbed Plaintiff violently by his disabled leg and neck and ripped him from the car. \n\nPlaintiff was then illegally searched, including in intimate areas, without legal justification. POs then slammed Plaintiff on a car before violently handcuffing Plaintiff's wrists with excessively tight cuffs. The cuffs caused Plaintiff to experience bruising, swelling, pain, and discomfort. POs, taking inappropriate advantage of Plaintiff's disability, then allowed Plaintiff to fall backward to the ground while handcuffed with no ability to catch himself. Plaintiff's cell phone had started recorded and continued recording as POs took possession of it. Plaintiff's cell phone documented POs mocking and ridiculing Plaintiff in their police car as they fabricated charges against him. Plaintiff was wrongfully imprisoned for approximately three hours before his release. Plaintiff was also maliciously prosecuted but all charges were terminated due to lack of probable cause. Officer Weisenburger then pushed the plaintiff's legs into the patrol car, closed the door in his face, and threatened him. At the precinct, the plaintiff continued to protest his unnecessary arrest. Defendant Sergeant Miele lied, claiming the plaintiff was brought to the precinct for the Sergeant's convenience and that he would be allowed to call the seller and then be released. Instead, the plaintiff was falsely charged with one felony, two misdemeanors, two violations, and three infractions. He was held at the precinct for more than 24 hours before being taken to see a judge. All charges were dismissed in the plaintiff's favor on July 16, 2021. Mr. Fair was lawfully present at the aforesaid location when Defendants, including illegally approached and questioned him, unlawfully questioned him regarding illegal activity, despite possessing no valid reason to inquire, as no criminal activity was reasonably suspected. The Defendants, including Pogosyan falsely accused Mr. Fair of committing criminal activities, including Resisting Arrest and Disorderly Conduct. The Defendants then conducted an illegal search of Mr. Fair's person by rifling through his pockets and patting him down all over. The Defendants then violently contorted Mr. Fair's arms behind his back and applied metal handcuffs to them in an excessively tight fashion, causing him substantial pain and discomfort. When Mr. Fair complained about the tightness of the handcuffs, his pleas to loosen them were ignored by Officer Pogosyan.\n\nThe Defendants then removed Mr. Fair to the 41st NYPD precinct against his will, where he was fingerprinted, photographed, strip searched and subjected to a cavity inspection. Mr. Fair was thereafter confined to a cell. Mr. Fair was then transported to Bronx County Central Booking where he was unlawfully detained and subjected to invasive searches and strip searches until his arraignment. While he was in illegal custody, Officer Pogosyan signed a criminal complaint against Mr. Fair, in which he knowingly affirmed the truth of the fabricated allegations against Plaintiff, namely that Plaintiff had committed criminal acts.
