Without provocation, a woman unknown by Plaintiff started aggressively verbally harassing Plaintiff, who ignored the woman and tried to walk away from her. Without provocation, the woman physically attacked Plaintiff, striking him in the face and ear with a high heel shoe, causing a laceration to Plaintiff's ear and bleeding. Plaintiff feared for his life and safety and attempted to defend himself; there were numerous witnesses, at least one of whom filmed the woman attacking Plaintiff without provocation before Plaintiff attempted to defend himself. Police officers entered the train at West 4th Station and were told by all witnesses that the woman was the aggressor, viewed the video, and saw Plaintiff bleeding while the woman-assailant did not have any injuries. \n\nOfficer Binagi and ten John Doe police officers handcuffed and arrested Plaintiff and transported him to a hospital for medical treatment for his injuries before transporting him to a precinct. The officers falsely communicated to the Manhattan DA that Plaintiff had committed a crime despite clear video evidence to the contrary and withheld the video from the DA's office. After several hours at the precinct, plaintiff was transported to Central Booking and detained for a total of 36 hours before being arraigned. Plaintiff was unable to pay $1000 bail and was remanded into custody. On or about November 11, all charges against Plaintiff were dismissed and he was released. The false arrest cause Plaintiff to lose his job, forcing him to borrow money from friends to pay his bills and negatively affecting his family.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=GGySlem0xnwyPeQ8YaIuZw==","type":"complaint"}]},{"name":"Phillips, Corey vs City of New York, et al.","start_date":"2014-03-18","disposition_date":"2014-08-20","payout_amount":25000,"disposition":"Settlement","docket":"14CV01711","court":"U.S. District Court - Eastern District NY","officer_name":"Stewart, Charles C.","summary":"On April 4, 2011, plaintiff and his friend Julio were sitting in a parking lot when they were approached by defendant officers who asked these men if they were in possession of any guns. They both told the officers that they did not, but Julio explained that he did in fact possess some marijuana in his sock. Julio gave the small amount of marijuana to defendant officers, and both individuals were subsequently arrested. The only defendants actually present at the scene of the arrest were Jackson and Stewart. However, defendant Jonny was assigned the arrest and signed the arrest paperwork as the arresting officer. The defendants then worked together to fabricate a story that Jackson and Stewart had seen plaintiff and Julio engaged an unusual amount of movement in the front seat of the car where they were sitting, which made the defendants suspicious that criminal activity was afoot. They further claimed that when they exited their vehicle to take a closer look at the front seat of plaintiff's car, they observed Julio handing currency to plaintiff and plaintiff handing Julio a small object. Julio then lifted this object to his nose and smelled it, at which time, Jackson, Stewart, and Jonny claimed, Jackson and Stewart were able to see that it was a small ziplock bag containing marijuana. Finally, the defendants claimed, they witnessed Julio throw the marijuana to the floor of the car when the defendants approached him, and that he picked it up and turned it over after Stewart directed him to do so.","documents":[{"url":"https://www.documentcloud.org/documents/4920100-Phillips-v-Stewart-et-al","type":"complaint"},{"url":"https://www.documentcloud.org/documents/4920099-Phillips-v-Stewart-et-al"}],"url":"https://www.courtlistener.com/docket/4520226/phillips-v-stewart/"},{"name":"Wright, Lahmeek vs City of Ny, et al.","start_date":"2013-09-26","disposition_date":"2026-01-22","payout_amount":0,"disposition":"Administrative Closing","docket":"502859/2013","court":"Supreme Court - Kings","summary":"On April 13, 2011 at 65 E. 96th St, Brooklyn, NY, Defendants approached Plaintiff with their loaded firearms, outstretched limbs and other objects which they used to physically seize, strike and restrain, and arrest plaintiff.
