When she opened the door, she was confronted by PO lieutenant Brian Query, and police officers Macciel Restituyo, David Perez, Lissa Solermarte, Praveen Davis, Alex Almonte Pichardo, Jason Gonzalez, Daniel Reisert and Flamur Gashi. The officers, who had received a 911 call, demanded to speak with the nephew and then, without a warrant or consent, barged into the apartment. Once inside, lieutenant Query asked Lee where her nephew was, and she responded that he was in his room. The officers then approached the nephew’s room, and PO Solermarte, Query, and Restituyo drew their tasers, even though the nephew posed no threat. Plaintiff, hanging back, asked the officers not to tase her “child.” In retaliation, lieutenant Query instructed the officers to arrest Plaintiff for obstruction of governmental administration. The officers did so – and they refused to tell Plaintiff that she was under arrest while handcuffing her, taking her to a squad car outside and driving her to the local precinct. The officers held Plaintiff at the precinct and questioned her for hours. When her blood pressure rose alarmingly, she was brought to a hospital and shackled to a bed there for hours more. Plaintiff was arraigned on December 5, 2021, and released on her own recognizance. In support of the charges, prosecutors presented a criminal complaint signed by PO Restituyo on December 4, 2021, which contained multiple demonstrably false statements made by officers. After Plaintiff’s release, she faced prosecution for months before the DA dismissed the charges on May 18, 2022, “in the furtherance of justice”. An unidentified officer demanded to see plaintiff's identification.  P.O.s Cummings, Nova-Diaz, and Reyes-Estrada reported falsely that they had been poisoned with an unknown cleaning agent and became ill from drinking the milkshakes.  The Detectives Endowment Association put out a statement on Twitter claiming falsely that three officers had been poisoned.  Afterward, the hashtag \"BoycottShakeShack\" was trending on Twitter.  At no point was plaintiff told why she was being detained.  Plaintiff was then detained at the precinct for 2 to 3 more hours.  She was questioned in a harassing manner by P.O.s Albert Vitarelli and Det. Lawrence Wien.  Neither plaintiff nor any Shake Shack employee was ever charged with a crime.  None of the officers ever became actually sick (they were released from the hospital after showing no symptoms).
