Plaintiff was separated from his wife and daughter at about 6:00 pm due to the police funneling protesters into a kettle in the vicinity of West 46th Street and 7th Avenue.  Plaintiff was pressed against a metal barricade the police placed between themselves and the kettled protesters, while Defendant NYPD Chief of Department Joseph Esposito and other NYPD officers shoved, punched, and kicked protesters, and NYPD officers on horseback threatened to trample plaintiff and other protesters. Defendant Esposito, the highest-ranking uniformed NYPD officer, personally reached across the barricade and pulled plaintiff towards him, while Defendant NYPD officer bearing shield number 5171 and defendant unidentified NYPD officer John Does struck plaintiff in his head with fists and a metal asp. Defendant Shield No. 5171 repeatedly struck and punched plaintiff in the head. Plaintiff was pulled behind police lines and thrown to the ground by Defendants Esposito, Shield No. 5171, and/or unidentified NYPD John Doe defendants. His left arm was then pinned under him as an unidentified defendant knelt on his back and pushed him into the cement. Plaintiff was directed despite being immobilized to put his hand behind his back, which he could not do. Plaintiff informed officers he could not move his arm or breathe, but defendants continued to kneel on and strike plaintiff.\n\nPlaintiff was brought to a nearby NYPD precinct, where Defendant Patrick Mullane processed his arrest. Plaintiff informed Defendant Mullane he needed to take medication in his backpack for his thyroid cancer, but defendant Mullane denied plaintiff his medication and any other medical treatment. Defendant Esposito arrived at the precinct, allegedly falsely informed officers at the station plaintiff tried to rip his badge off, and officers at the station began treating plaintiff in a more negative manner. Plaintiff was eventually brought to 100 Centre Street after an unspecified but excessively long period of time. Defendants Mullane and Esposito allegedly provide false information to the New York County DA. After more than 24 hours in custody, plaintiff pleaded not guilty to misdemeanor and violation charges sworn to by defendants Mullane and Esposito.
