Upon re-entering, the said vehicle was caused to shift forward. Officer Barret then entered said vehicle and began to forcefully repeatedly strike Plaintiff on his face and body. Defendant Rivera also entered the vehicle, climbed over the other plaintiff and tased the plaintiff decedent. Defendant Barret continued to strike the plaintiff decedent and Defendant Rivera fired a shot which killed Plaintiff decedent. Then Plaintiff Raymond Rivera was taken to the precinct where he was unlawfully held. Raymond Rivera was not told why he was being held, nor was he given an opportunity to make a phone call or offered any food. No charges were lodged against plaintiff Raymond Rivera resulting from this traffic stop.
