Jesus was lawfully driving a 1999 Jeep Grand Cherokee, which he double parked in front of a Jeans Star store. Kelly got out of the car to buy coffee while Jesus remained in the car with Jaline and Kidanny, who were minors at the time. Defendant Angel Vasquez and other unidentified officers surrounded the vehicle with guns drawn, violently pulled Jesus from the Jeep and threw him on the ground face down, all while still pointing guns at Jesus and the children inside the vehicle. An unidentified defendant placed his knee on Jesus's back, even though he was not resisting and was pleading for the officers to lower their guns because his daughter was crying hysterically. When Kelly approached the scene, she asked officers what was happening, and officers questioned whether Kelly was truly Jesus's wife, since Kelly is white and Jesus is Spanish.\nDefendants accused Jesus of driving a stolen vehicle. Upon being shown the proper paperwork, defendants then claimed the license plates were stolen. After about an hour with Jesus in custody and other plaintiffs unlawfully seized, defendants transported Jesus to the 41st precinct where he was held for 5-6 hours.
