Plaintiff's family was left in the car and forced to wait for hours until Plaintiff was released. Plaintiff was profiled and arrested on account of being African American.\n\nAt the precinct, Plaintiff was searched, placed in a cell, and processed. Several hours later, Plaintiff was issued two desk appearance tickets for Reckless Driving in and Disorderly Conduct. Plaintiff was arraigned on October 27, 2022 at Bronx Criminal Court. Plaintiff was required to appear multiple times in court after Defendants had incontrovertible evidence that Plaintiff was not involved in the alleged crimes he was arrested and charged with. Another passenger and the driver were also in the vehicle. The officers falsely accused the driver of running a red light. Although the officers had no probably cause to believe that plaintiff had committed any crime or offense, they forced plaintiff and his two friends out of the car and unlawfully searched them, the vehicle, and its contents. The officers recovered a bag from the vehicle and falsely accused plaintiff of possessing the bag and its contents. A later court ruling found the car stop and search was unlawful and \"an unnecessarily aggressive escalation of a simple traffic stop that was not legally justified.\" During the course of arresting plaintiff, defendant POs Nelson, Gonzalez, Kevin Earl, Steven Kallap, and Aman Rana used excessive force, slamming plaintiff on the ground and punching him multiple times, even after he was handcuffed.
