Defendant officers David Mercado, Ryan Gaynor, Peter Sotiriou, and 5 other John Does, approached the two outside. Officers made them produce ID, searched a parked vehicle, searched their persons, questioned, and harassed them. In response to learning the two came from a funeral, officers mocked the two men claiming that plaintiff Servius possessed marijuana, and asking if they mourn by smoking weed. Servius explained that they had no contraband. Plaintiff Harrell, seeing what was happening, came over and asked what was going on. One officer rushed at Harrell and began pushing, hitting, and punching him. The police tried to block people from filming. An officer punched and pushed Harrell several times, causing him to fall to the ground. Officers handcuffed Harrell and Servius and drove them to the precinct for processing. Plaintiff Harrell was released with with a desk appearance ticket and plaintiff Servius was sent for arraignment. Officers initiated a false sworn complaint to cover up their illegal actions. Plaintiff Servius was dismissed in adjournment of contemplation of dismissal with immediate sealing. Back at Central Booking, she was confined again in a cold cell with significant pain. She requested medical treatment but was refused by the officers. Since her release, she had to undergo dental surgeries.
