Prior to arriving, the plaintiff and his former passenger had engaged in a series of text messages. The plaintiff had offered to mail the former passenger their phone at no-charge. However, the former passenger requested that the plaintiff drive from New Jersey to Brooklyn and hand deliver the phone. The former passenger agreed to compensate the plaintiff for the trip, including lost fares resulting from the for-hire-vehicle traveling from New Jersey to Brooklyn. Shortly after the plaintiff returned the former passenger their phone, defendant NYPD officers, including defendant-Officer Sohn (Shield No. 22227), approached the plaintiff's vehicle and ordered the plaintiff to step out from the car.\n\nThe plaintiff left his car. Thereafter, the defendants forcefully arrested the plaintiff, placing the plaintiff in tight handcuffs. The defendants transported the plaintiff to a nearby precinct. There, the defendant-NYPD officers reviewed the text messages between the plaintiff and his former passenger, including text messages where the plaintiff offered to mail the former passenger's phone without charge and that the payment agreed to was solely for loss of compensation in the travel cost. Nonetheless, the defendants charged the plaintiff with petit larceny and possession of stolen property, and substantiated these charges when providing information to the King's County District Attorney's Office. The plaintiff remained in custody for two (2) days. Thereafter, the plaintiff was required to make seven (7) appearances in court.
