As Plaintiff was leaving the deli he was set upon by two officers, Sergeant David John and Officer Albert Aronov. Sergeant John grabbed Plaintiff in a way that Plaintiff's head smashed into a pole. When the stunned and disoriented Plaintiff got out of the deli to escape Sergeant John, Officer Aronov hit him in the head with a walkie-talkie, causing him to fall onto the ground. Officer Aronov continued to hit him with his walkie-talkie. Sergeant John began to kick and stomp on Plaintiff, and punched him in the face numerous times. The officers handcuffed him and transported him to the precinct, where he was not allowed to clean his bloody mouth and was refused medical care for his injuries. At Central Booking, he was released on his own recognizance. At the hospital, he was diagnosed and treated for numerous injuries. Officers John, Nicholson, and Aronov then falsely charged Plaintiff with resisting arrest and receiving stolen property. Mr. Zajackowski and his girlfriend were walking and reached the corner. Mr. Zajackowski (who holds a masters in Urban Planning and was employed as a transportation planner) noted the absence of proper traffic control signals and recalled an article regarding traffic safety issues within that precinct. Mr. Zajackowski recalled the presence of police officers nearby; he then approached the Officers to discuss traffic safety at the intersection. As he was speaking to the Officers, P.O. Szumilo, assisted by Sgt. John and P.O. Ambrosino, grabbed Mr. Zajackowski by his wrists and handcuffed him tightly. The Officers then placed him in a police van. Mr. Zajackowski told the Officers that the handcuffs were too tight and were causing him pain. An officer responded \"well, if you think that's tight you should feel the plastic handcuffs we use on protestors.\" He experienced pain and has suffered permanent neurological damage.\n\nMr. Zajackowski was transported to the 83rd Precinct station house, and placed in a holding cell. He was eventually released, after 2 hours, with a summons charging him with disorderly conduct. \n\nMr. Zajackowski appeared in court on April 3, 2013 but the hearing did not take place as the prosecution declined to proceed with the case. \n\nOn May 7, 2013, Mr. Zajackowski received a letter from the criminal court of the City of New York, County of Kings, stating \"the NYPD has dailed to dile a legally acceptable accusatory instrument with this court. Prosecutors refused to charge Plaintiff for lack of evidence.
