The Officer then stopped him and demanded identification. While Plaintiff was removing his identification, his prescription bottle of Clonazepam fell out of plaintiff's bag and rolled behind a nearby gate. When Plaintiff bent down and reached for his prescription medication, two male officers attacked him and in the process broke Plaintiff's arm. Defendants arrested Plaintiff and seized his prescription medication as evidence of his charges. After refusing the hospital, Defendants took Plaintiff to the 88th Precinct, and eventually to Brooklyn Hospital as Plaintiff's pain grew worse. Plaintiff's arm was placed in a cast and sling and he was brought back to the precinct and then to Brooklyn Central Booking. While Plaintiff was held at Central Booking, the District Attorney declined to prosecute the charges and Plaintiff was released after being in custody for a substantial portion of the day.
