In the police van, Defendant Police Officer Jerry Bowens planted drugs in Plaintiff 1's vicinity and used this as evidence to falsely arrest and charge Plaintiff 1. \n\nIn 2006, Plaintiff 2 was standing in the hallway of an apartment building when police raided the building and twice frisked Plaintiff 2 without lawful basis. As a result of this investigation writs of error coram novis convicting 378 people were vacated, including this plaintiff. This was due to a pattern of unconstitutional and illegal behaviour by the defendant officers. The NYPD and the Kings County DA office was aware of this pattern of behaviour and did nothing to prevent it. The refund of any fines, fees, assessments, restitution, or other assessments already paid by the defendant in connection with the now-dismissed case was explicitly denied in all 378 cases. Plaintiff was originally arrested in December 2003 and was a minor at the time by one of the defendant officers. Plaintiff then pled guilty to a narcotics charge and was therefore a youthful offender. While in the van, Plaintiff was kneed in his neck, back, and punched repeatedly in the face and/or body. While being transported to the 79th precinct, Plaintiff was placed in a chokehold. The officers did not have an arrest warrant or probable cause to believe a crime had been committed. They nonetheless arrested the Plaintiff. The officers had repeatedly kicked the front door causing damage to the door and the chain locks. Mr. Pajoohi slowly opened his front door and observed two uniformed police officers. The officers angrily demanded entry into his home. Mr. Pajoohi explained that everything was fine and his family was sleeping. The officer told Mr. Pajoohi that if he didn’t allow them entry he would “kick his teeth in”. The defendant officer than forced his way into the home by pushing Mr. Pajoohi, grabbing his arms and slamming his face against the wall. Stunned and frightened Mr.  Pajoohi began calling to his wife for help. Without explanation or cause, the officer again slammed Mr. Pajoohi into the wall and handcuffed him. He was then forcibly removed from his home and placed in a police vehicle. No illegal substance or contraband was ever discovered in Mr. Pajoohi’s possession, in his vicinity or inside his home.  Mr. Pajoohi was transported to the 79th precinct where he was searched, fingerprinted and photographed. Approximately twenty four hours later, Mr. Pajoohi was released from Central Booking. The Kings County District Attorney declined to prosecute the case. As a result of the officers’ assault, Mr. Pajoohi sustained swelling and bruising on his arms and legs. He suffered extreme emotional trauma from the officers forceful and unjustified entry into the home where his wife and daughter slept, form the physical attack and from the many hours spent incarcerated without explanation. Defendants ignored requests to be left alone and radioed an ambulance. Upon arrival,  EMS personnel grabbed friend against his will and tried to forcibly remove him. Friend pushed the EMS worker away which prompted defendants to radio for back-up. Fifty officers arrived, causing pandemonium on the street. An officer argued with friend's grandmother and pushed her. Another officer argued with friend's brother resulting in a physical altercation. Plaintiff went back home and yelled a profanity at the officers. Danese and Elliassen threw plaintiff up against an ambulance, but she fell to the ground hitting her hip. Officers grabbed plaintiff by the arms and dragged her to a patrol car. Defendants handcuffed her wrists excessively tight. Plaintiff was transported to the 79th precinct. Danese made false charges against plaintiff causing plaintiff to be prosecuted. Plaintiff was transported to Interfaith Medical Center for treatment. The next day plaintiff was taken to Brooklyn Central Booking. Danese made several misrepresentations to the Brooklyn DA resulting in criminal proceedings against plaintiff. After 29 hours, plaintiff was arraigned in Brooklyn Criminal Court and released on her own recognizance. Plaintiff made 12 appearances in court.
