Suddenly and without any provocation or legal justification, defendant police officers forcibly grabbed plaintiff and threw him down to the ground and began punching plaintiff in the face, head, and all over his body with a baton, causing plaintiff to suffer serious physical injuries to the face, eyes, body, and right elbow. Defendant police officers then unlawfully handcuffed plaintiff, forcibly lifted him off the ground, placed him in the back seat of the police vehicle, and transported him to the 40th precinct where plaintiff was fingerprinted, photographed, and unlawfully detained in a holding cell. While at the precinct, EMS was called to treat plaintiff for the physical injuries inflicted by the defendant police officers and plaintiff was further treated at Lincoln Hospital for numerous injuries on August 13, 2015 around 3:30 am. On August 13, 2015 at approximately 1:30 pm, plaintiff was discharged from the hospital and transported to central booking. \n\nDefendant police officers falsely stated to the Bronx County District Attorney’s Office that plaintiff had committed a crime despite knowing that they lacked a legal and a factual basis to allege that plaintiff committed any crime. On August 14, 2015, at approximately 1 pm, after around 36 hours in police custody, plaintiff was arraigned and the Judge set bail. The same day at 1 pm, plaintiff was able to post bail and was released from the courthouse. Plaintiff was charged with assault, disorderly conduct, obstructing governmental administration and harassment. After he was released, plaintiff received more medical treatment at Mt. Sinai Medical Center and complained to the medical staff at the hospital that his right elbow and face, among other things, were injured by defendant police officers. Plaintiff blacked out during the assault. Plaintiff was then put in a police vehicle and taken to the 40th Precinct.  At the precinct Plaintiff was taken from the vehicle, slammed into the doors of the building and thrown onto the floor of a bathroom. Plaintiff told defendants that he couldn't breathe and couldn't see because of the pepper spray and asked for help and water. Defendants told Plaintiff that he oculd remain where he was and to let that burn on you for a few minutes. Plaintiff was left on the floor in pain and then was directed to a sink to wash his face off. Plaintiff was then put in a holding cell where he blacekd out again. Plaintiff was charged with various violations but the People of the State of NY refused to prosecute Plaintiff for the charges. At 10:45 am on August 19,2014, Plaitniff was released from custody and then went to Lincoln Hospital for treatment for his injuries. An officer approached Quiles, told him his rear tail light was blinking, and asked for his driver’s license and registration. Quiles produced his driver’s license and registration, and the officer opened the rear passenger door of the vehicle and removed a bottle from the pocket of the passenger seat and asked what it was. Quiles responded that it was his daughter’s drink, “Malta.” The officer asked if he had been drinking and Quiles said he had not. The officers then returned to their patrol car and returned shortly thereafter, gave Quiles back his license and registration, and let him drive away. Less than five minutes later, Plaintiffs Quiles and Rodriguez were stopped again and Officer Flores asked Quiles for his license and registration. Quiles asked why but ultimately complied and asked if he was pulled over because of his tail light. Officer Flores said yes. She then asked Quiles if he had been arrested before, the nature of the offense, and when. Quiles explained he had been arrested before and answered Flores’s questions about the nature of the offense. \n\nFlores then asked Quiles if he had any drugs in the car, to which he responded no. She asked him to step out of the vehicle and Quiles complied. She searched Quiles, then handcuffed him and brought him to the back of the car. Rodriguez, who was sitting in the passenger seat, was ordered out of the car and searched. He informed the officers that he was diabetic and had insulin needles on him and that his cousin was taking him to the hospital. Officer Flores said “no its not” to Rodriguez’s assertion that the needles on him were for insulin. Officers handcuffed Rodriguez and searched the vehicle. Other officers arrived shortly after and drove away with Quiles’s  vehicle. The Plaintiffs were brought to the 40th precinct. Officer Flores informed Quiles he was being arrested because his cousin “had a needle and a beer” in his car and told both Plaintiffs that they were pulled over because of the broken front light. The Plaintiffs were physically searched and then transported to Central Booking.
