DFs then wrongfully and without a reasonable basis, probable cause or other legal grounds arrested PF for assault, domestic violence, and resisting arrest. In the act of handcuffing the PF and removing him from the premises and placing him in the DFs car, the DF officers used excessive and unnecessary force, throwing him into the patrol car and injuring him, despite being informed that PF had prior injuries to his neck and back and uncontrolled diabetes. DFs pushed the PF into the partition of the patrol car causing him to have injuries to his face, head, and neck. \nPF was arrested and taken to Central Booking in Richmond County. PF was detained for more than 1 day. PF family members continued to advise NYPD that there had been no assault by the PF, but NYPD continued to confine PF and did not attend to his injuries. Avellanet stepped outside to throw out a bag of garbage and was stopped and questioned by officers Charles Drobness and Ralph Conde, despite not committing a crime. The officers requested Avallenet's ID, and he refused after the officers refused to say why they needed it. The officers then grabbed him, and Avallenet pulled his arm away and escaped into the house. Other officers, including Thomas Nigro, Mary Gillespie, Yuriy Chuyko, Thomas Kamper, Efrain Hernandez, Johnny Castillo, Jason Greenberg, John Yen, Joseph Perfetto, Kenneth Greene, and Richard Guerrieri responded to the location. The officers began breaking the windows and Evelyn Lugo opened the door. The officers pulled her out of the house, threw her to the ground, and detained her outside for 30 minutes. An officer struck Avellanet 2 to 3 times with a hard object (likely a baton or flashlight) and brought him outside. Plaintiff Ortega approached the front door, and officers grabbed him, threw him to the ground, and struck him multiple times with a baton. An officer grabbed plaintiff Gregorio and threw her into a dresser with a birdcage on it, causing Lugo's bird to fall out. An officer killed the bird by stepping on it. Alba Cuevas and and George Lugo were upstairs with minor children, and after hearing the commotion exited into the hallway. The officers employed Oleoresin Capsicum spray in the hallways, spraying George Lugo, Cuevas, Gregorio and the children. Cuevas had to retreat to the bedroom to catch her breath because she suffers from asthma. After the spraying, an officer struck George Lugo twice with a baton, and once Lugo fell to the ground, the officers held his arms behind his back and continued to strike him. Plaintiff Cruz began yelling at the officers to stop hitting him and was struck three times with a baton. The officers then handcuffed George Lugo and took him into custody. They also kicked the bedroom door open to arrest Cuevas twisting her arms behind her back and placing tight handcuffs over her writsts.\n\nAfter receiving medical treatment, Ortega, George Lugo, and Cuevas were imprisoned until they were arraigned on September 4, 2012 for baseless charges based on falls allegations from Drobness, Conde, and Nigro.
