Once on the platform, Officer SAFUTO grabbed Plaintiff's arm, and placed it behind his neck, causing the Plaintiff great pain due to pre-existing injuries to Plaintiff's neck, back, shoulder, wrists, and ankles, which required Plaintiff to walk with a cane. After grabbing the Plaintiff, Officer Safuto also snatched away his cane, stated \"You don't need this...\" and threw it to the ground. As a result of Officer Safuto's actions, Plaintiff's pre-existing injuries were exacerbated. PO Safuto subsequently arrested Plaintiff and fabricated an account of the events to justify his use of force, including fabricated allegations that he observed the Plaintiff lying outstretched across multiple subway seats. Plaintiff was charged with violating 21 NYCRR 1050.7(j)(2) by placing his feet on a subway seat. Plaintiff was detained for 48 hours before being released.
