Glasgow provided a valid New York state non-driver's ID as his license had been suspended. Bonanno and Fragedis removed Glasgow from the vehicle, searched him, and then searched the entire vehicle without a warrant. The search yielded no weapons, drugs, or other contraband. POs Rich and Karabin arrived on the scene and the officers placed Glasgow under arrest. They took Glasgow to the 67th precinct, where they searched him again and recovered only his keys, phone, and cash. The officers then questioned Glasgow to elicit information about guns or drugs. Glasgow provided the location of a gun that belonged to one Andre Carrasco, which was stored under the outside stoop near Glasgow's apartment.\n\nAfter allowing Glasgow to call his wife, defendant officers spoke to Glasgow's wife, Plaintiff Patrina Carter, on the phone, and instructed her to retrieve the gun, wipe it clean, and give it to the officers when they arrived. Calls from Glasgow's phone to his wife's phone were placed an additional 4 times while he was in custody. The officers went to Carter's location and retrieved the gun with Carter's help. Later, the officers took Glasgow's cell phone from him, demanded his PIN code, and erased his call logs to conceal their activity. POs Bonanno, Rich, Fragedis, and Karabin forwarded false evidence about the recovery of the gun to the Kings County DA's office. Glasgow was charged with criminal possession of the loaded firearm, among other charges. PO Bonnano falsely stated that the weapon was recovered from the trunk of Glasgow's car in a search conducted at the precinct. Glasgow was indicted on these charges.\n\nOn March 27, 2013, Glasgow was again taken into custody for allegedly walking between subway cars. He was never charged or cited for this offense but held in jail on the previous charges emanating from his Nov. 14, 2012 arrest. He was held until August 1, 2013, when the DA's office moved to dismiss all charges. The arrest and prosecution were deemed a nullity. Then, without any reasonable basis or probable cause for doing so, police officers approached, stopped, searched and detained Plaintiff. The search yielded no evidence of any guns, drugs, or contraband, but the officers nevertheless arrested Plaintiff. Sergeant Rich arrived at the scene and supervised the arrest. Plaintiff did not know why he was being arrested, but while it was happening he overheard on the officers’ police radios that other members of the NYPD were apprehending, or had apprehended, other individuals in the area for gun possession, which Plaintiff would eventually be charged with. \n\nPlaintiff was transferred to a precinct where he was held for several hours. While at the precinct, officers Sargent, Riche and Bute subjected Plaintiff to excessive force by striking him on his face and body. The use of force lacked any justification. Plaintiff repeatedly requested medical attention for the injuries he incurred, including cuts and lacerations he sustained to his face, but the officers refused to provide medical attention. The officers assaulted, battered, and threatened Plaintiff, in order to coerce him into putting on a red sweatshirt and Cardinals baseball cap, which Plaintiff did not own, and which Plaintiff was not wearing that evening. Plaintiff was then transferred to Central Booking, where he was held for several more days before he was arraigned on a criminal complaint containing false allegations sworn to by officer Sargent. Officer Rich, officer Sargent’s supervisor, approved the arrest and paperwork related to Plaintiff’s arrest, and failed to prevent the illegal acts taken by his colleagues. Pursuant to the knowingly false allegations made by the officers, Plaintiff was charged with criminal possession of a weapon. Plaintiff was then transferred to Rikers Island, where he remained in custody for several more days.
