Agho parked in the driveway of his home and the parties exited the vehicle. Plaintiff and the two females began to walk away from the vehicle and house, while Agho walked toward the front of his home. Defendant officers approached Agho and ordered him to stop, without reasonable suspicion or probable cause to believe Agho committed a crime or violated the law. Agho asked the officers why they were ordering him to stop but received no answer.\n\nAgho turned around with his back to the front door and was face to face with one of the Defendant officers. Without first saying anything, the officers assaulted and battered Agho by physically pushing him away from the other officers and into the front door, with an unreasonable amount of force. Fearful for what was occurring and not understanding why the Defendant officers were acting in this manner, Agho retreated inside of his home and closed the door behind him.\n\nPlaintiff had barely walked off of the property when the interaction began but witnessed the entire situation. Plaintiff returned to Agho’s home and walked up to the front porch and stood with the officers. Defendant officers attempted to open the metal gate that was locked which covered the front door to Agho’s home. Agho’s mother, the owner of the home, opened the front door to speak to the officers through the metal gate. At that point, Plaintiff attempted to leave because the atmosphere was becoming too heated and he thought it safer if he got off the porch. As Plaintiff attempted to leave the porch, one of the Defendant officers pushed him very forcefully on his back, causing him to fall down the stairs onto two police officers. The officers proceeded to grab Plaintiff and throw him over a gate located in front of the house. The Defendant officers punched Plaintiff in the face several times and pinned him to the ground.\n\nThe Defendant officers unlawfully handcuffed Plaintiff and falsely arrested him, without probable cause or any legal justification. Plaintiff was transported to the precinct where he was unlawfully searched, fingerprinted, photographed and detained in a holding cell for many hours. Plaintiff Miller was in the passenger seat of a car, and when POs Brian Ramirez and Justin Vasquez yelled at the Plaintiffs for not social distancing, SH got into the driver's seat. PO Ramirez demanded to see SH's DL, which was provided. PO Vasquez demanded to see Miller's ID; Miller refused since he was not doing anything. Miller began recording the interaction with his cell, and PO Vasquez slapped it out of his hand and began hitting Miller. SH then began recording, and the officers threw him to the ground and PO Ramirez began striking him with a bit stick. Sgts Darren Caranella, and Troy Peacock and POs Sean Slowski, and Christopher Read pinned SH to the ground, kneeing and striking him as they placed handcuffs on him. Plaintiff Boyce began recording the assaults, and POs Ramirez, Vasquez began beating him. POs Charles Ji, Michael John, Stephen Rice, Sgt Troy Peacock, and Lts Alexander Bobo and Michael Parscale joined in the assault as they arrived. PO Stephen Rice tased Boyce for several seconds before handcuffing him. Boyce, SH, and Miller were taken to the 073 Precinct, where they were taunted by PO Vasquez and Ramirez. Ramirez chocked Miller in the precinct. SH and Miller were released at 3pm and Boyce was released shortly after 5pm on April 6 without having been charged nor seeing a judge. \nOn April 8, 2020, Plaintiff Denzel Bobb was driving his vehicle, looking for parking SH was in the passenger seat, and Shaquweice Mills was in the rear seat. As Bobb was about to park, plainclothes Sgt Samuel Hui and Steven Franzel with officers Keith Stark, Richard Catapano and Vincent D'Andraia arrived in unmarked cars. They alleged that the car had a broken tailight. As Bobb attempted to retrieve the vehicle registration he was asked for by Sgt Hui, he was pulled out of the vehicle and Hui, Stark, and Franzel began beating him. SH and Mills were taken out of the vehicle by Franzel and Catapano and forced to sit on the ground with their handcuffs throughout the assault. Hui pointed his taser at them. Plaintiff Lavon Bartholomew witnessed the assault began recording. PO Stark told him to turn off the light on his camera, Bartholomew complied. Stark and D'Andraia approached Bartholomew again, slapped his phone out of his hand, whereupon they began beating him along with PO Richard Catapano. Upon handcuffing him too tightly, Catapano smashed his head on the sidewalk. Defendants kneed, kicked, and struck Plaintiff about the body as he laid on the concrete ground. Defendants illegally searched Plaintiff and transported him to the 73rd Precinct. While in custody, Plaintiff was illegally searched again and placed into a holding cell.  During this time, Plaintiff continued to ask why he was being arrested, for which he was told he would not be processed and would receive a Desk Appearance Ticket. Eventually, Plaintiff received the DAT but was not free to leave as he was then interrogated and was released after approximately being held unlawfully for 3 hours. Plaintiff was forced to seek medical attention to treat his injuries. Defendants P.O. Jason L. Smith, P.O. Joseph C. Sicari, and other unidentified officers detained Spann at gunpoint, directing him to lie on the ground. While he complied, the officers proceeded to kick him, pin him down with their knees on his head, and tightly handcuff him, causing cuts and bruises to his wrists. Despite being handcuffed and subdued, the officers continued to physically assault him, resulting in serious injuries. Spann was also subjected to an illegal search, which yielded no contraband. He was later transported to the NYPD-73rd Precinct and detained before being released after prosecutors declined to press charges.\n\nA similar incident occurred on August 25, 2019, where Spann was again arrested without cause near the corner of Mother Gaston Boulevard and Sutter Avenue in Brooklyn. During this arrest, the officers kicked and tripped him, causing him to fall and sustain further injuries. Spann was once again tightly handcuffed and beaten by the officers, who ignored his requests for medical treatment.
