Plaintiff was smoking a cigarette. A police vehicle pulled up alongside plaintiff. Tiernan stated he smelled marijuana. Plaintiff informed Tiernan he was smoking a cigarette. Three officers exited the vehicle and approached plaintiff. Tiernan, observing plaintiff was holding a beverage, demanded to know what he was drinking. Plaintiff replied that he was drinking cranberry juice and showed the bottle he was holding. Another officer demanded to know where plaintiff lived. Plaintiff produced ID. Tiernan informed plaintiff the officers smelled marijuana and plaintiff was holding an open container. Plaintiff was tightly rear-handcuffed and placed in the back of a police vehicle. Plaintiff's father arrived at the scene and an officer falsely and maliciously informed plaintiff was drunk and resisting arrest. Lewis issued two summonses to plaintiff, one for having an open container in public and disorderly conduct. Plaintiff was then released. On October 5, 2012, the summons for having alcohol in an open container was dismissed in Criminal Court.
