Plaintiff was sleeping when Defendants, officers including Ayala Morales and Montanez broke down Plaintiffs door and began unlawfully searching Plaintiff's apartment. Defendants, entered plaintiff's apartment without a judicially authorised warrant and proceeded to unlawfully arrest the plaintiff without any legal justification. Defendants, never observed plaintiff commit any crimes or violate any law. Defendants used excessive force while arresting the plaintiff and battered the plaintiff including placing him under tight handcuffs and lifting him to his feet by his wrist which caused substantial pain and physical discomfort. Subsequently, Plaintiff was transported to the 40th precinct where he was criminally processed, which included fingerprinting, retina scans and illegal searched including various invasive bodily searches. Then after plaintiff was taken to the Bronx County Central booking. Baile was set but plaintiff was unable to post and thus he was transported to the Vernon C. Bain Correctional Center where he was unlawfully detained for approximately one week. Defendant made fabricated allegations against plaintiff that  he was in possession of several weapons. Eventually all charges against the Plaintiff was dismissed on October 31, 2019. Defendants lacked a valid arrest warrant, had no probable cause for the arrest or seizure of the Plaintiff, and did not have grounds to believe that the prosecution would succeed or that the Plaintiff was guilty of any crime. The defendant police officers arrested him and attempted to initiate a criminal prosecution to gain overtime pay, benefits as well as to meet departmental arrest quotas. Defendants covered up their violations of police procedures and misconduct, including fabricating observations, evidence, and information. Plaintiff was deprived of his liberty and suffered various physical,\nemotional and psychological injuries. Plaintiff said he was waiting for a resident of the premises to come outside to where Plaintiff was waiting. Defendants asked plaintiff for identification and to search Plaintiff and his possessions. Plaintiff asked why he had to be searched. Defendants handcuffed Plaintiff. Other officers, James rodriguez, Juan rodriguez, steven Oquendo, Jason Fernandez, Oswaldo Maldonado, David Montanez and Officers John doe 1-6 came to the premises and some officers grabbed Plaintiff, threw him to the grown and handcuffed his hands behind his back.Plaintiff was kicked in the arms and legs, and was hit with a police baton on his legs, arm and head and sprayed in the face with pepper spray and assaulted. Plaintiff blacked out during the assault. Plaintiff was then put in a police vehicle and taken to the 40th Precinct.  At the precinct Plaintiff was taken from the vehicle, slammed into the doors of the building and thrown onto the floor of a bathroom. Plaintiff told defendants that he couldn't breathe and couldn't see because of the pepper spray and asked for help and water. Defendants told Plaintiff that he oculd remain where he was and to let that burn on you for a few minutes. Plaintiff was left on the floor in pain and then was directed to a sink to wash his face off. Plaintiff was then put in a holding cell where he blacekd out again. Plaintiff was charged with various violations but the People of the State of NY refused to prosecute Plaintiff for the charges. At 10:45 am on August 19,2014, Plaitniff was released from custody and then went to Lincoln Hospital for treatment for his injuries.
