The police car then looped around the block again, and Mr. Jarvis observed four police officers dressed in plain clothes exit the vehicle and approach his\ngroup. The four police officers never identified themselves. Mr. Jarvis and his friends began walking away from the corner as the officers approached.\nAn officer called out to him to stop, but Mr. Jarvis knew that he had done nothing wrong and continued walking-he did not run or attempt to flee. The defendant officer then sped up his approach and tackled Mr. Jarvis from behind, scraping his face against the ground and causing back and shoulder injuries in the process.\n\nWith the officer on top of him, Mr. Jarvis was scared and in pain. Multiple officers\nthen joined their colleague and handcuffed Mr. Jarvis. After he was handcuffed, the officers searched him and recovered a small handgun that was secured in his underwear. At that point, after Mr. Jarvis was arrested and the gun was recovered, the officers turned on their body cameras. Once Mr. Jarvis was on the ground, he was immediately arrested and transported to the police precinct. Mr. Jarvis was charged in Bronx County with criminal possession of a weapon. Mr. Jarvis was held on bail on Rikers Island until June 28, 2018, when he was writted to the Southern District of New York and charged by complaint with being a felon in possession of\na firearm. On July 9, 2018, a grand jury returned an indictment against Mr. Jarvis.  He was unable to meet bail and spent over a year in prison as he awaited trial. On April 30, 2019, Judge Crotty granted Mr. Jarvis' motion to suppress, finding that the Government failed to satisfy its burden to show there was probable cause to arrest Mr. Jarvis or reasonable suspicion to stop him and that the search of Mr. Jarvis violated his Fourth Amendment rights.\n\nThe conduct of the individual Defendant Police Officers Anthony Cassase, Daniel Maria, Robert Cabrera in unlawfully restraining, searching, seizing, assaulting and arresting Mr. Jarvis proximately caused physical, emotional and financial injury to him, as well as serious physical and emotional pain and suffering, mental anguish, shock, fright, physical pain, humiliation, embarrassment and deprivation of Plaintiff's constitutional rights. POs constructed a false narrative wherein Plaintiffs allegedly resisted arrest, among other crimes. The malicious prosecution of the Plaintiffs was terminated in Plaintiffs' on January 31, 2020. The Defendants, \nfabricated a false narrative, in which they claimed that the Plaintiff, Mr. Surgeon committed one (1) count of Resisting Arrest, one (1) count of Criminal Mischief in the fourth degree, one (1) count of Unlawful Possession of Marijuana and one (1) count of Disorderly Conduct to place him under arrest, when they knew such claims to be untrue and complete fabrications. The Defendants also fabricated a false narrative, in which they claimed that the Plaintiff, Mr. Fenner committed one (1) count of Resisting Arrest, one (1) count of Obstructing Governmental Administration in the second degree and one (1) count of Harassment in the second degree to place him under arrest, when they knew such claims to be untrue and complete fabrications. The Plaintiffs were transported by Defendants to the NYPD 44th Precinct, where they were illegally searched, photographed and fingerprinted. Plaintiffs were wrongfully incarcerated over the course of eighteen (18) hours. Based on misleading information provided by defendants, the DA then prosecuted plaintiff with criminal charges, which were all then dismissed in plaintiff's favor due to lack of sufficient legal basis. While plaintiff was walking home, the three defendant police officers were in an unmarked black car and began following the plaintiff in their car.  When the plaintiff was just a few blocks from his house, the three defendant police officers pulled up behind the plaintiff and got out of their car.  One of the officers yelled at the plaintiff to slow down, without making the plaintiff aware that he was a police officer.  Two of the officers walked up to the plaintiff and violently grabbed him from behind and threw him into the wall of a nearby building.  The third officer began punching the plaintiff on various parts of his body, and the other two officers joined in, hitting and kicking the plaintiff in various parts of his body as well.  The officers then threw the plaintiff to the ground and kneed, kicked, and punched him all over his body.  They scraped the plaintiff's hands on the concrete ground, causing severe bruises.  The officers handcuffed the plaintiff, who asked the officers why he was being arrested.  The officers told him that he had beat up a little girl.  Plaintiff was searched on the street, but nothing illegal was found on his body.  Then one of the officers lowered the plaintiff's pants and touched plaintiff's genitals for a few minutes.  Plaintiff was transported to the 44th Precinct, where he was processed and searched again - one of the officers again touched plaintiff's genitals. Plaintiff was detained until 8 PM on October 8, 2017.  Plaintiff was charged with criminal possession of a controlled substance, among other charges.  On February 14, 2019, all charges were dismissed.  \n\nIn a separate incident, on March 18, 2016 at approximately 1:30 AM, the plaintiff was arrested by defendant police officer Rattan and other unnamed officers near 235 2nd Avenue, New York, while walking on the street.   The officers violently grabbed the plaintiff and threw him to the ground, beaten and kicked all over his body, causing him to suffer injuries to his head and other parts of his body.  Plaintiff told the defendants that he had done nothing wrong and there was no reason to arrest or assault him on his birthday.  He was arrested on the street, searched, and nothing illegal was found on him.  Plaintiff was transported to the 13th Precinct, where he was later charged with criminal possession of marijuana in the fifth degree and resisting arrest.  He was released on bail.
