Before said date and time, a store clerk called 911 to report that the Unknown Assailant had assaulted the Plaintiff with a knife. The defendant officers, Damien Clark, Krystal Class, and ten more unknown officers, appeared in response to the 911 call and illegally approached, stopped, and detained the Plaintiff and questioned him about the aforementioned assault. The Plaintiff explained that he was battered and assaulted with a knife by the Unknown Assailant who was still present in the vicinity and provided readily available exculpatory information to the officers who ignored him. Instead, they began to question him about whether he was in criminal possession of a knife without any legal justification. The defendant officers then questioned the store clerk who indicated the Plaintiff did not possess a knife and was a victim of the assault by the Unknown Assailant who was still in the vicinity. The officers ignored these statements and indicated they would handcuff the Plaintiff while they continued their investigation without legal justification. When the Plaintiff asked why the officers were handcuffing him, they falsely accused the Plaintiff of the criminal offense of resisting arrest. The officers then physically battered and assaulted the Plaintiff by aggressively grabbing him with their outstretched hands, tackling him on the ground, and punching and kicking him on the head and body, causing the Plaintiff to suffer substantial pain, to come into forceful contact with the hardened ground on the right side of his body, shock, and significant emotional distress. The officers then continued to physically batter and assault the Plaintiff and electrocuted him without any threat posed by the Plaintiff causing him to suffer substantial pain, to have his skin pierced by taser projectiles, and further shock and extreme emotional distress. The officer's search yielded no contraband or any evidence indicating Plaintiff had committed a criminal offense including possession of a knife. Afterwards, the officer violently contorted the Plaintiff's arms behind his back to affix metal handcuffs to his wrists in an excessively tightened fashion.  Even though the Plaintiff complained that the handcuffs were too tight and painful, the officers ignored and/or refused to loosen the handcuffs. The officers then placed the Plaintiff in a police vehicle and transported him to the NYPD 76th Precinct where he was fingerprinted, searched or strip-searched with attendant cavity inspection, photographed, questioned as to his pedigree, unlawfully interrogated without presence of counsel, denied medical attention, and illegally detained in a dark and dirty cell for approximately one (1) day.
